Thank you for purchasing an Align Technology, Inc. (“Align”) Invisalign™ UV Sanitizing Case (“Device”). Align warrants this Device against any defects in materials or workmanship that materially affect Device performance or functionality (“Limited Warranty”) for a period of six (6) months from the original date of purchase (the “Limited Warranty Period”).
Coverage and consumer remedies
This Limited Warranty is only valid and enforceable in the country where you, the consumer, purchased the Device from Align. The Limited Warranty covers normal use of the Device by the original user: (i) in accordance with the provided instructions; (ii) during the Limited Warranty Period; and (iii) solely with Invisalign clear aligners. If a defect arises and Align receives a valid claim within the Limited Warranty Period, Align will, at its option, repair the Device using new or refurbished replacement parts or exchange the defective Device with a functioning Device (in which case the replacement Device becomes your property upon delivery to you, and the defective Device becomes Align’s property upon return shipment to Align) or refund the purchase price of the defective Device. Any repaired or replaced Device will be covered for the time remaining on the original Limited Warranty Period or (if longer) for a period of thirty (30) days from the date of delivery to you of the replaced or repaired Device. Align will bear the cost of shipping for valid claims made under this Limited Warranty.
Exclusions and limitations
Align does not warrant that the operation of the Device will be uninterrupted or error-free. This Limited Warranty does not apply to and specifically excludes normal wear and tear to the Device, as well as damage caused
by any of the following: (a) use of the Device with any product or device other than Invisalign clear aligners; (b) accident, abuse, misuse, immersion in water, prolonged exposure to extreme temperatures, flood, fire, earthquake or other external causes or acts; (c) operation of the Device outside the permitted or intended uses described by Align; (d) failure to follow the provided instructions (including without limitation charging the Device with any power supply not specified in the Device instructions); (e) any modification to the Device (including without limitation alterations, service, or disassembly) by the end user or by any third party for any reason; or (f) the included lithium-ion polymer battery(ies) and ultraviolet light components.

EXCEPT AS PROVIDED IN THIS LIMITED WARRANTY, ALIGN DISCLAIMS ALL AND ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. REPAIR, REPLACEMENT, OR REFUND (AS DESCRIBED ABOVE) WILL BE THE EXCLUSIVE REMEDY OF THE CONSUMER. ALIGN IS PROVIDING THIS LIMITED WARRANTY IN LIEU OF ALL OTHER EXPRESS OR IMPLIED WARRANTIES. NO ALIGN RESELLER, AGENT, OR EMPLOYEE IS AUTHORIZED TO MAKE ANY ORAL OR WRITTEN MODIFICATION, EXTENSION OR ADDITION TO THIS LIMITED WARRANTY. IN NO EVENT SHALL ALIGN, WHETHER IN CONTRACT OR TORT (INCLUDING NEGLIGENCE), BE LIABLE FOR DAMAGES IN EXCESS OF THE PURCHASE PRICE OF THE PRODUCT, OR FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR FOR DAMAGES TO, OR LOSS OF, OTHER PROPERTY OR EQUIPMENT OR PERSONAL INJURIES TO THE FULL EXTENT THESE DAMAGES MAY BE DISCLAIMED BY LAW.
This Limited Warranty and these disclaimers and limitations are all subject to applicable local laws, and you as a consumer may have additional rights that vary from jurisdiction to jurisdiction. Please contact Align customer support within the Limited Warranty Period for further instructions on how to make a claim under this Limited Warranty. Please advise the customer service representative that you are calling to make a warranty claim on an Invisalign sanitizing device and be prepared to provide the following: (a) Device name and any model or serial number, (b) a description of the Device defect, (c) proof of purchase and your order number and details (including date and place of purchase), and (d) your return shipping address (Align cannot ship to P.O. boxes).
